What you need to know about injury claims against the government

August 5, 2025Jamie

You may have a case against a negligent government agency if you were injured on public property. This could mean slipping on a poorly maintained sidewalk, falling after grabbing a loose stair railing in a public building or getting hurt in a crash caused by a dangerously designed intersection.

However, it’s not business as usual. Filing an injury claim against a public entity isn’t like going after a private individual. These cases have strict deadlines, detailed procedures and specific requirements. One slight mistake could derail everything.

You have six months to act

In California, claims against government entities must begin with a written notice of claim, and you only have six months from the date of your injury to file it. This notice informs them that you intend to seek compensation and outlines the details of your injuries, how and where they happened and why you believe the government entity is responsible.  Each government entity generally has their own specific form which must be used.

You could lose your right to recover damages if you miss this deadline, which is why you need to act quickly and submit your claim on time.

What comes next?

The government entity has 45 days to respond once you file your claim. They may accept it and offer a settlement or propose a resolution. If they deny or ignore your claim, you may proceed to file a lawsuit (within the legal time limits).

Legal guidance is essential

Government injury claims are notoriously complex, with layers of bureaucracy to navigate that can be overwhelming if you go it alone. Having someone who understands the ins and outs of suing a government agency can help you avoid costly errors, protect your rights and build a strong case from the start. You can significantly increase the chances of a desirable resolution of your claim with the proper legal support.
